These Terms & Conditions ("Terms") govern your access to and use of PesaPulse (pesa-pulse.co.ke), operated by PesaPulse ("we", "us", "our"). By creating an account or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use PesaPulse.

1.Acceptance of terms

By registering for a PesaPulse account, browsing gigs, or completing any task on our platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

2.Eligibility

To use PesaPulse, you must:

• Be at least 18 years old.
• Be a resident of Kenya with a valid, active M-Pesa registered phone number in your own name.
• Provide accurate and truthful information when registering.
• Have the legal capacity to enter into a binding agreement.

3.Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at admin@pesa-pulse.co.ke if you suspect unauthorized use of your account. You may only create and operate one PesaPulse account.

4.Gigs and completion

PesaPulse lists gigs such as email replies, comment replies, customer service, surveys, and data entry submitted by us or our partners. By accepting a gig, you agree to:

• Complete the gig honestly, accurately, and to the standard described in the gig details.
• Not submit false, duplicate, spam, or low-quality work.
• Not use bots, scripts, or automated tools to complete gigs.

We reserve the right to review, approve, or reject any gig submission at our discretion. Rejected submissions will not be paid, and repeated low-quality or fraudulent submissions may result in account suspension.

5.Payments & M-Pesa payouts

Approved gig earnings are paid directly to the M-Pesa number registered on your account. Payout timing is described on our FAQ page and may vary by gig type. PesaPulse does not charge any fee to join, apply for gigs, or receive payouts. You are responsible for ensuring your registered M-Pesa number is accurate and active; PesaPulse is not liable for payments sent to an incorrect number provided by you.

6.Acceptable use

When using PesaPulse, you agree not to:

• Provide false identity, contact, or payout information.
• Create multiple accounts to claim gigs or bonuses more than once.
• Attempt to interfere with, hack, or disrupt the platform.
• Use PesaPulse for any unlawful purpose.
• Harass, abuse, or impersonate PesaPulse staff, partners, or other users.

7.Intellectual property

All content on PesaPulse, including our logo, branding, design, and platform software, is owned by or licensed to PesaPulse and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our content without prior written permission.

8.Suspension & termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the platform. You may also close your account at any time by contacting us.

9.Disclaimers

PesaPulse is provided "as is" without warranties of any kind. While we vet gig partners, we do not guarantee a minimum number of available gigs at any given time, nor guaranteed earnings. Gig availability and payout amounts may vary.

10.Limitation of liability

To the fullest extent permitted by Kenyan law, PesaPulse shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including loss of earnings, data, or opportunity, except where such liability cannot be excluded by law.

11.Governing law

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of PesaPulse shall be subject to the exclusive jurisdiction of the courts of Kenya.

12.Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of PesaPulse after changes take effect constitutes acceptance of the revised Terms.
